DMCA Copyright Policy

CNWTone respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website (the “Site”) that are properly reported to our designated copyright agent.

If you are a copyright owner or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing the notice procedure below.

1. Filing a DMCA Notice

To submit a notice of claimed infringement, you must provide our designated agent with a written communication that includes substantially the following:

  1. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.

  2. Identification of the infringing material that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the specific page or article).

  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  6. Your physical or electronic signature.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and make a good faith attempt to notify the user who posted it.

2. Counter‑Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter‑notification. Your counter‑notification must include:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal.

  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  3. Your name, address, and telephone number.

  4. A statement that you consent to the jurisdiction of the federal district court in your judicial district (or, if outside the United States, the jurisdiction where CNWTone may be found), and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person.

  5. Your physical or electronic signature.

Send the counter‑notification to the same DMCA agent contact above. If we receive a valid counter‑notification, we may restore the removed material within 10‑14 business days unless the original complainant files a court action seeking an injunction.

3. Repeat Infringers

CNWTone reserves the right, in its sole discretion, to terminate the accounts or access of users who are determined to be repeat infringers of copyright.

4. Misrepresentations

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or that it was removed by mistake may be liable for damages (including costs and attorneys’ fees).
